									<p>Thousands of people from Europe who are currently in Britain may potentially be affected by the UK’s exit from the European Union. Things look very uncertain for Britain’s relationship with the rest of Europe, so what might it mean personally to those who have established themselves in the UK?</p>

<p>Firstly it would be the end of the fast-track EU-only lines at passport control; the return of work permits for employees; the abandonment of reciprocal public healthcare arrangements; tighter restrictions on studying and doing business; possible higher taxes on foreign property ownership and cash transfers between member states, and the treatment of foreign pensions to name a few.</p>
<p>The practical consequences of the UK’s exist from the European Union, for the approximately 2.4 million EU citizens that are in Britain and nearly 2 million Britons estimated to be living on the continent are not yet clear. For migrant workers, it will all depend on whether the UK government decides to negotiate free movement, or if they will impose a visa system. This in turn will have an effect on the right of permanent residence (PR) in the UK. Permanent residence was introduced by Directive 2004/38/EC (the Citizens’ Directive), which was transposed into the UK by the Immigration (European Economic Area) Regulations 2006 Permanent Residence (PR) is a separate status from Indefinite leave to remain and is derived solely from European Union (EU) law. It is no longer possible for EEA nationals or their third country national (TCN) family members if they are residing in the UK under EU law to apply for Indefinite leave to remain under the immigration rules. However, PR is acquired automatically on meeting the relevant conditions. An application is therefore, made to confirm rather than to obtain permanent residence, and there is often no need for an EEA national living in the UK to make such an application. The usual situation where permanent residence has to be proved is in the context of an application by their third country national family member prior to the expiry of their 5-year EEA residence card. It also arises in benefits cases where EEA nationals are seeking to show that they have acquired permanent residence and hence have access to more benefits. However, with the forthcoming referendum on the UK’s continuing membership of the European Union now coming closer, some EEA nationals may need to prove their settled status and we would recommend that EEA nationals to protect their immigration position by naturalising as British citizens or at least applying for confirmation of their permanent right to reside in the UK. It is very important that EEA nationals seeking to do this are aware that, unless certain exemptions apply, from the point they obtain British citizenship, they, and any family members, may no longer have an EU right of residence in the UK, including a right of permanent residence.
It is also important to note that, from 12 November 2015, EEA nationals or their third country national family members relying on a European Union’s permanent right of residence in citizenship applications are required to submit with their application, a permanent residence card, and document certifying permanent residence. Previously, it has been sufficient to provide evidence of the relevant person having acquired permanent residence. </p></p><p>Now, the relevant document confirming permanent residence will have to be obtained first from the Home Office to accompany the citizenship application.</p>								</div>

									<p>Tier 1 and 2 PBS – with effect from 6th April 2015</p>
<p>Immigration &amp; Border Policy Directive recently made changes to Tier 1 &amp; 2 categories of the Points Based System in order to offer greater flexibility under these immigration routes to support business practices and increase economic benefits to the UK. The changes are as follows:</p>
<p>Provision of greater flexibility for tier 2 migrant workers</p>
<p>There is a welcome change to the ‘cooling-off period’, to enable flexibility for genuine short term business stays in the UK. The cooling-off period will now be waived for grant of leave of less than 3 months. This means that where a migrant worker</p>
<p>– Is assigned a COS for 3 months or less in the preceding 12 month period, and had no other Tier 2 leave during that period, the cooling- off period will not apply;</p>
<p>– Has had more than one period of Tier 2 leave in the last 12 months and each COS was assigned for a period of less than 3 months, even where they total over 3 months, the cooling- off period will not apply. Other changes include the amendment of the Shortage Occupation List, changes to the minimum salary thresholds, and appropriate salary rates.</p>
<p><strong>Tier 1 change</strong></p>
<p>– Tier 1 (Investor) Migrants would be required to open a UK regulated bank account before they apply for their visa. This is in line with due diligence checks that would need to be carried out by the banks before the migrant applies for entry clearance or leave to remain.</p>
<p>– The minimum age of investors has been increased from 16 to 18 years as the Home Office is of the view that younger adults (16 &amp; 17 year olds) would not be able to control wholly their funds.</p>
<p>– Tier 1 (Investor) migrants would no longer need to ‘top-up’ their capital if they sell part of their investment at a loss. They would be required to maintain that capital within their investment portfolios. This will also apply if they sell part of their investment at a profit. They would be required to reinvest the capital in specified investments.</p>
<p>– Tier 1 (Investors &amp; Graduate Entrepreneurs) are now restricted from investing in companies dealing with property investment, development or management as is applied to Tier 1 (Entrepreneur) category.</p>
<p>– Tier 1 (Entrepreneur) applicants would be required to submit their business plan at the initial stage of their application. If they have held their funds for less than 90 days, they would be required to show evidence of third party source of funds. The genuineness test will also now be applied at the extension and ILR application stages.</p>
<p> </p>
<p>– Tier 1 (General) migrants will no longer be able to apply to extend their leave (from 6th April 2015). Applications for indefinite leave to remain will no longer be accepted in the Tier 1 (General) category from 6 April 2018.</p>
<p> </p>
<p>– Tier 1 (General) Migrants will also not be able to apply to switch to Tier 1(Entrepreneur) category, unless they have already established a business before 6th April 2015, or they have obtained funding from a government department or a seed funding competition.</p>								</div>

									<p>The government has now announced, that from 1 February 2016, all private landlords in England will have to check new tenants to have the right to be in the UK before renting out their property.</p>

<p>Right to rent was introduced in the Immigration Act 2014 as part of the government’s reforms to build a fairer and more effective immigration system. The first phase was launched in parts of the West Midlands, the next stage of the scheme will be rolled out from the 1st February 2016 nationally.</p>

<p>Under right to rent, landlords should check identity documents for all new tenants and take and retain copies. The scheme has been designed to make it straightforward for people to give evidence of their right to rent and a range of commonly available documents can be used.</p>

<p>Landlords will need to carry out thorough immigration status checks on their prospective tenants before granting tenancies in the future or face stiff penalties of £3000 for each adult living in their property who isn’t a relevant national or has no right to rent. There also the possibility of further sanctions in the form of imprisonment of up to five years.</p>

<p>The move comes following a trial of the landlord checking service in the West Midlands which began in December 2014. Under the trial, landlords have to carry out checks to ensure their tenants are in the UK legally. From the 1st February 2016, Landlords have to ensure they are making the right checks and collecting the right documentary evidence for each tenant – which will depend on whether they are British, have settled status or have only limited leave to stay in this country.</p>								</div>
